Unlimited Data Plans - Fair Use Policy
About this policy. This policy explains how our unlimited data packages work and how you should use them. It applies to all unlimited data packages available through our website, platform and app. This policy should be read together with our General Terms, our Terms of Use for our Services and our Acceptable Use Policy. When we say “Airalo”, “we”, “our” or “us” we mean AirGSM Pte Ltd, a company registered in Singapore at 6 Raffles Blvd, #03-308 Marina Square, Singapore 039594. By purchasing or activating an unlimited data package, you agree to comply with this policy.
How can I use my unlimited package? Our unlimited data packages are designed for personal, non-commercial use. You are welcome to use your package for everyday activities like browsing, streaming, messaging, video calling and social media. You can also use your device as a personal hotspot to share your connection with other devices. There is no limit on tethering or the number of devices you connect.
What do we mean by “unlimited”? Our unlimited data packages don’t have a fixed total data cap. However, to keep the network running fairly for everyone, when you use more than 3GB in a day, we’ll slow down (or “throttle”) your internet speed to 1 Mbps for the rest of that day. Your full high-speed connection will automatically be restored after midnight, local time.
The default daily high-speed data threshold is 3GB. Where a different threshold applies, it will be clearly set out in the package details before you buy. For the purposes of this policy, "day" means the 24-hour period that resets at midnight, as specified in your package details.
What can I do at 1 Mbps? At 1 Mbps, you can still send and receive messages, browse simple web pages, use maps for navigation and make lower-quality video calls. Data-heavy activities like video streaming, gaming or large file downloads will be slower until your speed resets.
Things we ask you not to do. To protect the network and keep our service fair for all users, the following uses of an unlimited data package are not permitted:
- reselling, redistributing or commercially sharing the data connection with third parties;
- operating the data connection on an unattended, automated or machine-to-machine basis, including through SIM farms, auto-diallers, bulk messaging systems or similar automated tools;
- using the data connection in a way that unreasonably degrades or congests the underlying network for other users (e.g., continuously uploading or downloading very large files at high speeds for extended periods, running peer-to-peer file sharing applications, hosting a web or game server);
- using the data connection for any unlawful purpose or in breach of applicable law; and
- attempting to circumvent or undermine any network management measures applied under this policy.
We will act reasonably in deciding whether a particular use falls within the above.
Network management. The networks that power our packages may apply traffic management during busy periods. This can result in speed reductions that are separate from the daily 3GB threshold described above, and are outside of Airalo's direct control. Airalo makes no warranty as to connection speed, quality or availability at any given time.
Breaches of this policy. If we reasonably believe that you are using an unlimited data package in a way that breaches this policy, we may, without prior notice:
- suspend or restrict access to your package and Airalo account;
- terminate your package without a refund; or
- take any other action we consider reasonably necessary to protect the network and other users.
A breach of this policy also constitutes a breach of our Acceptable Use Policy and General Terms, and the remedies available to us under those documents will apply.
General. We may update this policy from time to time. We will notify you of material changes in line with our General Terms. Changes take effect from the date of publication and apply to packages purchased on or after that date.
This policy and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute or claim.
